TERMS OF USE FOR THE @MEDIA SERVICE AND @MEDIA END-POINT DEVICE

1. SUBJECT

These Terms of Use (hereinafter referred to as “Terms”) govern the conditions and procedures under which ATMEDIA EUROPE LTD., with its registered office in Bulgaria, dist. Krasno selo, Municipality Stolichna, str. Han Persian No. 10, ent. B, fl. 1, ap. 4, 1612 Sofia (hereinafter referred to as “@media”) provides its @media network users with access to the @media service on the @media end-point.

2. DEFINITIONS

For the purposes of these Terms, the following definitions shall apply:

• “@media box”: represents the @media end-point device

• “@media end-point”: A terminal device (“@media box”) that enables @media network users to access the @media service.

• “@media service”: A service providing @media network users with the ability to view advertisements on their television screens in formats such as L-banners or full-screen ads, tailored to the preferences of the users.

• “Service Provider”: The company @media, which owns the platform and provides the @media service.

• “@media network user”: A natural or legal person who utilizes the @media box and @media service for personal purposes.

• “Cooperation Partner”: Authorized myWorld partners to distribute @media end-point devices.

3. TERMS OF USE

• Access to the @media service is obtained only by creating an account on the myWorld platform using a unique username and password.

• @media network users are responsible for safeguarding their login credentials and must not disclose them to unauthorized third parties. The Service Provider assumes no liability for any damages resulting from unauthorized access due to inadequately secured log-in data by the @media network user.

• The Service Provider does not guarantee uninterrupted availability of the @media service.

• Temporary interruptions may occur due to scheduled maintenance, technical issues, or circumstances beyond our control. We are not liable for any resulting loss of use or damage.

• @media network users are solely responsible for the installation, adjustment, and management of the @media application on the @media box. The Service Provider has no access to, nor control over the installed devices and is not liable for any technical issues or malfunctions.

• The @media service is available in all countries where @media operates. A current list of active countries is available at www.atmediaworld.com/countries. Use is restricted to personal, non-commercial purposes. Public display, redistribution, or resale of the service content is strictly prohibited.

• No monthly subscription fee is required for the use of the @media service.

4. DESCRIPTION OF THE SERVICE

The @media service includes:

• The display of targeted advertisements based on the @media network user’s preferences.

• Advertisements appear as an L-banner, covering 15% of the TV screen, and can transition to full-screen mode by pressing the OK button on the remote control. Pressing the OK button again will display a QR code linking to the advertiser’s URL.

• Each advertisement is displayed for a maximum of 10 seconds in L-banner mode and an additional 20 seconds in full-screen mode.

• @media network users are permitted to connect a single @media end-point per account.

• @media network users can configure ad frequency (e.g., every 15 minutes) and choose which ads to view based on their interests (e.g., Travel, Fashion, Beauty), as well as the languages in which ads are being shown ensuring that only relevant ads are displayed.

• @media network users are able to see the history of advertisements shown on the @media end-point.

5. DATA PROTECTION

Your use of the @media service is subject to our Privacy Policy. Personal data may be transferred outside the EU/EEA using GDPR-approved safeguards (e.g., Standard Contractual Clauses).

By using the @media service, you acknowledge that your personal data will be processed in accordance with our Privacy Policy. You have the right to access, correct, or delete your data, and to withdraw consent for marketing communications. For requests, contact [email protected]. Data transfers outside the EU/EEA use GDPR-approved safeguards (e.g., Standard Contractual Clauses).

6. TECHNICAL REQUIREMENTS AND PARAMETERS

• Use of the @media service requires the installation of a terminal device (@media end-point).

• The @media end-point requires an internet connection via cable (LAN), Wi-Fi, or hotspot. A wired connection is recommended for optimal performance.

• The @media end-point must connect to an external input device (e.g., digital receiver, Android box, Apple TV, Fire TV) via an HDMI cable or via RF input (antenna).

• The @media network user acknowledges and agrees that a stable and high-quality internet connection is required for optimal service functionality, with a minimum recommended speed of 256 kbit/s.

• The @media end-point must be connected to an external output device, e.g., television or video projector and the device must have an HDMI input to connect the @media end-point connection.

7. TERMS OF USE OF THE @MEDIA BOX

The @media end-point device is provided by @media or within the service companies related.

• The @media network user is receiving the @media end-point device but is not the owner of the device. Ownership of the @media end-point device remains with ATMEDIA EUROPE LTD. The @media network user is granted a non-transferable right to use the device but shall not acquire any ownership rights.

• Upon termination or the cancellation of the @media service, the @media network user agrees to return the device in good working condition, along with all original accessories (e.g., power adapter, remote control, HDMI cable). Failure to return the device upon request may result in liability for the current replacement value of the device, determined based on its market price at the time of non-return. Users are responsible for damage caused by misuse.

• When a Cooperation Partner provides an @media end-point device to an @media network user, the transaction is documented through a delivery note issued at the time of handover.

• @media network users are responsible for the proper care and maintenance of the @media end-point. Any damage caused to the device must be compensated according to the current market price.

• In the event of damage or malfunction, @media network users agree to repair or replace the device at their own expense.

• EU/EEA users retain statutory rights under Directive 2019/771, including remedies for defective devices or services. Contact [email protected] to exercise these rights.

• We shall not be held liable for indirect, incidental, or consequential damages arising from the use or inability to use the @media service or end-point device, except in cases of intentional misconduct or gross negligence.

• The license granted includes a requirement for annual maintenance, which provides users with ongoing access to updates, technical support, and service coverage. This maintenance must be renewed annually to continue receiving benefits under the license.

• A license is considered active once the user logs into the @media end-point using their myWorld account credentials. Activation triggers the start of the maintenance and benefit period.

• License codes can only be activated in countries where the @media network is officially supported. A list of such countries is available at: www.atmediaworld.com/countries.

• In the event of termination of a user’s myWorld membership, the license may be reassigned to another eligible @media end-point user by an authorized Cooperation Partner.

• Authorized Cooperation Partners who assign licenses to @media end-point users agree to indemnify ATMEDIA EUROPE LTD. against any claims arising from such assignments.

8. FINAL PROVISIONS

By accepting these Terms of Use, @media network users confirm their full understanding and acceptance of the rights and obligations outlined herein.

9. GOVERNING LAW & DISPUTES

These terms are governed by Bulgarian law. EU/EEA users may lodge complaints via the EU ODR Platform. All disputes shall be resolved in the courts of Sofia, Bulgaria.

10. UPDATES

We may update these Terms periodically. Continued use after changes constitutes acceptance. Updates will be posted on our website and notified via email.
